Government contract law and bankruptcy law are each creatures of complex and heavily regulated regimes. The financial viability of many government contractors may rest on one or two awards that may be derailed by a dispute over one contract. Such contracts may be different from the ordinary executory contracts familiar to many bankruptcy practitioners. The interplay between bankruptcy and government contracts is increasing, with some of the largest recent filings by government contractors in critical sectors such as energy, technology, and manufacturing. The cases can even involve assets with implications for national security, creating more complexity when attempting a sale of assets under the Bankruptcy Code. This program, led by experts from both fields, will give both government contracts practitioners and bankruptcy professionals the tools to understand the range of issues to best represent their clients.
