In recent years, we have seen a sharp increase in the financing of business or corporate aircraft, including many transactions involving "like-kind exchanges" and the acquisition of fractional interests in airplanes. Many of these transactions are structured as synthetic leases, and they frequently involve leases or management agreements heavily influenced by operational and sales tax considerations.
We act for entities and individuals in their negotiations of purchase contracts for both new and used aircraft. We also assist in the structuring aspects, helping clients find the most appropriate jurisdictions for the purposes of registration and tax planning. Our experience on the financing side also permits us to suggest relevant structuring ideas to allow for eventual bankability of the funding of the purchase price.
Further, we act for financiers in this sector on a wide range of matters, from bilateral leases and hire-purchase agreements, to multi-aircraft portfolio funding.
