The European Corporate Restructuring & Bankruptcy Group offers commercial advice in the following key areas:
- Restructuring and refinancing - We advise on rescue packages, corporate restructurings, debt refinancings and UK schemes of arrangement, as well as on corporate disposals in distressed situations. Our arrangements will often enable a profitable business to emerge from the disposal of a loss making division and /or assets. We frequently advise on turnarounds, often representing turnaround professionals.
- Formal Insolvency and recovery - We regularly advise on formal insolvency processes including, in the UK, administrations, solvent and insolvent liquidations, voluntary arrangements, and fixed charge receiver appointments. We have experience in advising on transaction avoidance, including UK preferences and transactions at an undervalue (and equivalent concepts in Continental Europe).
- Strategic advice -- In situations where a re-organisation may not be fully or partially possible, we represent secured and unsecured creditors, providing advice on the manner in which to obtain maximum recovery on any lending or exposure in the minimum time. We also represent creditors who have contractual relationships with companies with deteriorating financial positions.
- Regulation - We represent insolvency practitioners and company directors, providing advice on directors' duties and responsibilities in an insolvency situation, and on regulatory requirements imposed by government departments in distressed situations
