Recent rulings have imbued CAFA removals and challenges to personal jurisdiction with renewed vitality, and give corporate defendants new strategies to consider when facing litigation in a distant or hostile court.

The Class Action Fairness Act of 2005 – more commonly known as CAFA – gives federal courts an expanded jurisdiction over class actions and mass actions that meet certain criteria. Although plaintiffs often try to stay below the thresholds that would permit defendants to use CAFA to remove to federal court, courts increasingly recognize that plaintiffs can trigger CAFA jurisdiction when they seek to consolidate cases for trial. As for personal jurisdiction challenges, they have been of little use to corporations that do business nationwide – until now. Recent decisions give all defendants new tools to resist litigation in distant – sometimes hostile – courts.
