This program will address the attorney-client privilege and work product doctrine, and the particular complexities of applying those doctrines in the ERISA fiduciary context.  This program will cover:

  • The basic elements of the attorney-client privilege and the work product doctrine
  • Recent developments in privilege law
  • The competing policies of full disclosure in the trustee-beneficiary relationship and the confidentiality of attorney-client communications
  • The influence of Garner v. Wolfinbarger on the fiduciary exception to the privilege
  • The work product doctrine and the fiduciary exception
