This program will address the attorney-client privilege and work product doctrine, and the particular complexities of applying those doctrines in the ERISA fiduciary context. This program will cover:
- The basic elements of the attorney-client privilege and the work product doctrine
- Recent developments in privilege law
- The competing policies of full disclosure in the trustee-beneficiary relationship and the confidentiality of attorney-client communications
- The influence of Garner v. Wolfinbarger on the fiduciary exception to the privilege
- The work product doctrine and the fiduciary exception
