Over the last four years, hundreds of intangible holding companies have filed NJ corporation business tax returns under VDAs and closing agreements covering throwout and nexus issues. The NJ Division of Taxation is now auditing and assessing those returns. In many cases, taxpayers who thought they had resolved their throwout exposure are now facing multimillion dollar assessments.
