In response to the global needs of our clients, Reed Smith is pleased to announce our 2008 "Doing Business Globally" teleseminar programs, a series of programs focused on issues that businesses should understand about doing business in the global marketplace. The experience of the attorneys in our 23 offices in the United States, Europe, Asia and the Middle East positions us to assist in helping you to address the global landscape. The first teleseminar will discuss Foreign Corrupt Practices Act ("FCPA") Compliance Programs. Effective FCPA compliance programs are becoming increasingly critical for global enterprises. In particular:

  • Enforcement fines are on the rise: Baker Hughes ($44 million), Titan ($28 million), Lockheed Martin ($26 million), Schnitzer Steel Korea ($7.5 million), ABB U.K. ($5.5 million).
  • Enforcement against individuals routinely follows disclosures and settlements: Salam (three years), Martin ($30,000 fine), Sapsizian (facing $250,000 in fines and 10 years), Ott and Young (facing $250,000 in fines and five years).
  • Increased enforcement capacity and international cooperation makes enforcement more likely: The U.S. Department of Justice and the SEC are increasingly joining with foreign regulators to investigate violations under the OECD Anti-Bribery Convention and other anti-bribery provisions, as well as the FCPA.
  • For companies buying or selling an international business, FCPA compliance needs to be part of the due diligence protocol.
