As the summer heats up with a new round of incoming interns, now is a good time to measure the temperature of your internship program β€” legal or illegal?

Over the past few months, several class-action lawsuits (with more likely on the horizon) have been filed by interns claiming they should have been paid. These lawsuits allege many company internship programs violate a federal wage and hour law called the Fair Labor Standards Act. Under this law, if a company requires or allows an intern to perform actual work that primarily benefits the company instead of serving more of an educational purpose, it could be forced to pay hourly wages and overtime compensation.
