Alan is a partner in the firm's Real Estate Group. He concentrates his practice in commercial real estate transactions, focusing primarily on acquisitions, development, and zoning and land use. Alan also has significant experience in commercial leasing.

His broad experience includes representing developers and users in commercial and multi-use developments; obtaining local and state zoning, land-use and other approvals and permits, including Highway Occupancy Permits from the Commonwealth of Pennsylvania; negotiating purchase and sales agreements and loan documents; drafting and negotiating commercial leases (for landlords and tenants); representing owners in sales/transfers, refinancings and restructurings of affordable housing projects; and reviewing and negotiating surveys and title insurance policies. He also has been involved in numerous real estate, business acquisition and sale transactions occurring in bankruptcy proceedings.

Significant matters Alan has handled in the area of development/land use include representing:

  • A major national retailer in the development of new and expanded stores throughout Pennsylvania, handling all aspects, including acquisition, land-use and zoning approvals, and entitlement and permitting issues
  • A national pharmacy-chain developer in obtaining local and highway occupancy permit approvals
  • The owner of an adult cabaret in obtaining local land-use approvals for the operation of the business
  • The owner of a limited use bed and breakfast facility in obtaining land-use approvals and the financing of the project with Federal historic tax credits

Significant matters Alan has handled in the area of HUD financing and affordable housing include:

  • The acquisition and HUD-approval of the transfer of physical assets of a 200-unit apartment complex in Western Pennsylvania
  • More than 20 HUD Mark-to-Market closings, from both the owner and PAE sides
  • Numerous refinancings of HUD-insured projects under various HUD loan programs, including section 236 "decouplings," and sections 223(a)(7), 221(d)(3) and 223(d)(4)
  • Negotiating numerous management agreements for the management of tax-credit-financed and other subsidized housing projects
  • Obtaining HUD approval of Ground Lease of part of parking lot of HUD-insured project in connection with renovation and expansion of historic theater
  • Refinancings of three assisted living facilities, including one owned by a non-profit corporation, through HUD's LEAN Program

Significant matters Alan has handled in the area of leasing include representing:

  • The landlord of a large office building and several small office buildings in downtown Pittsburgh in new leases, lease amendments and lease terminations
  • Tenants for the leasing of office space throughout Pennsylvania and elsewhere
  • A landlord and management company in general leasing and landlord tenant matters for retail and office properties throughout Pennsylvania
  • Landlords in the leasing of rooftop space to cellular telephone carrier tenants in various leases for office space in downtown and suburban Pittsburgh
  • A nonprofit corporation in negotiations for the termination of its existing space and leasing of new office/medical office space in suburban Pittsburgh
  • A landlord in the negotiation of lease termination agreements for office space and a daycare center as the result of a casualty in the building

Alan was also a Pennsylvania licensed title insurance agent for seven (7) years as part of his prior practice
