Nan is a member of the Life Sciences Health Industry Group, practicing in the area of health care regulatory law. Her practice focuses on the intersection of health care and technology, relying on her significant expertise in Medicare and Medicaid reimbursement, HIPAA, health information privacy, and interoperability, Anti-Kickback Statute, beneficiary inducement, Stark, and 60 Day Overpayment Rule compliance to inform digital health strategies and arrangements. She has extensive experience counselling a range of health care providers and manufacturing entities (including IDTFs, telehealth providers, medical device companies, pharmacies, hospitals, and other related companies in the life sciences and health care space, along with technology companies on collaboration agreements, value-based arrangements, strategic data partnerships, mobile health solutions and applications, connected devices, and breach incident response.
She has most recently been advising numerous clients on the Interoperability, Information Blocking and Patient Access final rules. Together, these rules establish new data sharing principles for the health care industry that build upon existing HIPAA requirements. Nan is working with all impacted stakeholders - health IT companies, health care providers, and health plans - to design compliant processes that preserve critical investment in health IT while facilitating appropriate access, exchange, and use of electronic health information.
Nan also effectively translates her regulatory expertise into defensive strategies and counsels a wide variety of health care and life sciences companies in government investigations, administrative audits, and False Claims Act litigation. Nan is known for creative and practical solutions to complex regulatory issues that are informed by a deep understanding of the health care industry and appreciation for her clients’ businesses, operations, and health IT systems.
