Reed Smith’s state tax group will present a teleseminar next Wednesday, August 20 focusing on the sales factor of your 2007 California franchise tax return. We will discuss whether the FTB’s new regulation, which excludes all treasury receipts from the sales factor and is effective starting with the 2007 year, violates statutory principles and the state supreme court’s decision in Microsoft. We will also discuss the Montgomery Ward decision and its implications. Any taxpayer with an out-of-state treasury department that is considering including treasury receipts in its sales factor on its 2007 tax return should participate in this teleseminar.
