On Aug. 3, 2007, the SEC issued a Release that adopts a new antifraud rule under the Investment Advisers Act of 1940 ("Advisers Act"). New rule 206(4)-8 prohibits advisers to investment companies and other pooled investment vehicles from making false or misleading statements to, or otherwise defrauding, investors in those pools, as well as prospective investors.
