Gary is a member of the Financial Industry Group, practicing in the area of Financial Services Litigation.  Gary's commercial litigation practice focuses on individual and class actions in the consumer financial services and securities areas.  He also has broad experience in general commercial and other complex litigation.  Gary has defended numerous class action cases across the country at trial and in appellate courts.

Representative Matters

  • Won summary judgment and defeated class certification in a class action against a national credit card issuer in case involving allegations of bankruptcy reaffirmation fraud.  Prevailed on appeal in the Seventh Circuit.

  • Successfully represented a variety of national mortgage lenders in numerous class action and individual suits involving TILA, mortgage fraud and foreclosure issues.

  • Defeated class certification in a TILA class action against a national credit card issuer in a case involving allegations of improper increases in interest rates.

  • Won motion to dismiss class action against national credit card issuer in case involving alleged misrepresentations regarding fee-based services.

  • Successfully defended numerous federal securities fraud class actions, including obtaining a defense verdict in a federal jury trial.
