Tracy is an intellectual property litigator in Reed Smith’s Philadelphia office and the former head of Reed Smith’s Intellectual Property Group,  She represents clients in patent, trademark, trade dress and copyright infringement disputes, trade secret litigation and other technology-related matters.  In 2008, Tracy was included in IP Law & Business' annual listing of the "Top 50 Under 45" IP attorneys in the United States.

Representative Matters

  • Checkpoint Systems, Inc. v. All-Tag Security S.A., et al.:  obtained full defense verdict of patent invalidity, non-infringement and unenforceability in two-week jury trial for manufacturer of anti-theft security devices accused of patent infringement.

  • Clock Spring L.P. v. WrapMaster, Inc., et al :  obtained summary judgment of patent infringement and summary dismissal of antitrust counterclaims for plaintiff in case involving methods for repairing oil and gas pipelines.

  • Schering-Plough v. Fruit of the Earth, Inc. (N.D.Tx; 2008): Successfully represented Schering-Plough in trade dress infringement suit against leading manufacturer of generic sunscreen products which knocked-off Schering-Plough’s famous COPPERTONE® line of products. In preliminary injunction proceedings, obtained a ruling requiring defendant to change its product packaging within two weeks.

  • Koons v. ART:  obtained a jury verdict in excess of $1 million for Jeff Koons, a world-renowned artist, in a dispute with a foundry retained to cast some of his sculptures.

  • Represented manufacturer of electronic learning devices in International Trade Commission action to enjoin competitor’s importation of infringing products
