Mark has considerable litigation experience, having tried multiple cases.  Although he focuses his practice on commercial litigation, Mark has developed substantial experience in prosecuting and defending claims challenging the conduct of corporate officers, general partners, trustees and other fiduciaries.

Representative Matters

  • Successfully defended general partner against breach of fiduciary duty claims seeking more than $270 million in damages for allegedly failed private equity investments.

  • Obtained order removing majority trustees of client’s $65 million trusts and appointing client’s hand-picked successors as replacement trustees.

  • Defended president of privately held government contractor accused by majority shareholder of misappropriating corporate and partnership assets for personal gain.

  • Prosecuted claims of limited partners of real-estate partnerships against general partner for self-dealing, breach of fiduciary duty.

  • Obtained order from the Pennsylvania Supreme Court vacating a $3.5 million verdict against newspaper client after adducing evidence at second trial of impropriety in the assignment of original trial judge.  (Thomas A.
