Represented a restaurant franchisor in litigation filed to force the closure of a franchisee's restaurants due to operational deficiencies.
Played an instrumental role in obtaining denial of class certification in nationwide, statewide and foreign class action cases for major insurance companies in “vanishing premium” and other market conduct litigation
Advised the receiver of a failed bank pursuing claims under the Financial Institutions Reform, Recovery and Enforcement Act (“FIRREA”) against former bank officers regarding scope of officers’ indemnification from bank holding company under Office of Thrift Supervision (“OTS”) regulations.
Obtained a temporary restraining order in federal court requiring a former franchisee to cease using the franchisors’ trademarks and proprietary system, while simultaneously defeating the former franchisee’s request for a temporary restraining order that would have required the franchisor and its affiliates to continue doing business with a terminated franchisee.
