Our client approached us for advice in relation to the resignation of certain senior individuals and the imminent defection of a team to a competitor.  There was evidence that these senior individuals had taken significant amounts of confidential information belonging to our client, in breach of their garden leave obligations.  We obtained from the UK High Court ex parte orders (providing interim injunctive relief, production of computers and documents, and for affidavit evidence to be provided), and served these at each of the individuals’ homes.  Following careful analysis of forensic evidence that revealed further breaches and contempt of court, we used the evidence to achieve a very favourable settlement for our client, which included significant business protection relief and a contribution of 90 percent of its costs.
