Eric focuses his practice on international and domestic regulatory compliance and enforcement matters, white collar criminal litigation, civil false claims litigation, and securities enforcement. He counsels clients primarily in the health care, financial services and defense industries. Eric deals extensively with federal prosecutors and enforcement attorneys and state attorneys general. He has broad experience in representing clients in Securities and Exchange Commission investigative and enforcement matters.
In March 2020, after two years of pre-trial litigation and less than one month prior to trial, Eric obtained a dismissal with prejudice for Concord Management & Consulting, a Russian company indicted by Special Counsel Mueller and prosecuted by the U.S. Department of Justice for alleged interference in the 2016 U.S. election.
Eric works extensively overseas conducting internal investigations relating to the Foreign Corrupt Practices Act. He has managed FCPA investigations in over twenty-five countries. Eric also counsels clients in export control matters.
Eric has represented pharmaceutical and medical device manufacturers, drug wholesalers, long-term care and retail pharmacies, pharmacy benefit managers, nursing homes and hospitals in false claims, fraud, anti-kickback and consumer protection matters. He has also represented banks and other regulated entities in securities enforcement matters.
In 2017, after two years of pre-trial litigation, Eric obtained a dismissal with prejudice for HCR Manorcare in a False Claims Act case relating to alleged unnecessary rehabilitation therapy intervened in by the U.S. Department of Justice. The critical factor causing the government to dismiss the case was Eric’s obtaining exclusion of the government’s expert witness.
Eric worked as a federal and state prosecutor for 17 years. He served as lead government counsel in more than 100 state and federal jury trials. Since joining Reed Smith, he has litigated criminal and civil jury trials relating to the FCPA, economic espionage, theft of trade secrets and obstruction of justice. He has represented numerous clients in securities enforcement and FCPA matters.
