Adam routinely advises on a range of regulatory compliance and operational issues, including pollution and contamination risks, climate change and emissions trading, product compliance and liability, environmental permitting, licensing, waste management and producer responsibility obligations, and operational health and safety. Adam has particular expertise in EU product safety and chemical regulation under REACH, CLP, RoHS and CE marking.
Adam has assisted clients with multi-jurisdictional projects, compliance initiatives and lobbying activities in areas such as product safety and stewardship, climate finance and carbon emissions, renewables, brownfield redevelopment, waste treatment and disposal, and site decommissioning and remediation.
Adam has significant experience advising on environmental issues and risks arising in corporate, finance and real estate transactions, having acted on a number of complex transactions involving heavily contaminated sites. He advises clients how to eliminate or mitigate environmental liability risks, by negotiating appropriate risk transfer mechanisms or by putting the client in an informed position where they can take a commercial view on their potential exposure to liabilities.
Adam’s contentious practice encompasses both criminal and civil environmental matters. On the criminal side, he advises clients in relation to regulatory investigations and enforcement proceedings brought by the Environment Agency, HSE and other regulators. On the civil side, Adam advises clients in relation to carbon trading disputes and nuisance actions.
