Eric is a member of the firm’s IP, Tech & Data Practice Group and represents clients in a variety of matters, including patent litigation, post-grant review proceedings, covered business method reviews, counseling, estate management, due diligence, licensing, and transactions in a wide range of technical fields, including the pharmaceutical, life science, medical device, specialty chemical, computer, software, and mechanical fields. He counsels clients to protect, maintain and enforce intellectual property rights; defend claims brought against them by both practicing and non-practicing entities; and develop collaborative strategies to help navigate the complexity of intellectual property asset transactions.
Eric has 30 years of patent litigation experience, including litigation in federal district courts in numerous jurisdictions, proceedings before the Patent Trial and Appeal Board, alternative dispute resolution proceedings, appellate practice before the Court of Appeals for the Federal Circuit, and petitions and amicus briefing before the United States Supreme Court. His litigation experience includes developing cost-effective strategies to enforce patent rights, as well as defend against patent claims. His experience also includes an in-depth knowledge of damages and remedies for patent infringement, and he has worked closely with economic consultants and experts to develop damage strategies for trial.
Eric also has 30 years of experience in patent licensing, transactions, patent estate management, and due diligence studies. He assists clients in evaluating intellectual property portfolios of prospective licensors and acquisition targets, as well as developing effective technology and business strategies for companies and universities seeking to protect their innovations and maximize intellectual asset value. His experience further includes negotiating and drafting other intellectual property agreements, and successful settlements of existing patent litigation.
Eric has written and lectured on a wide range of patent-related topics, including patent damages, litigation best practices and evolving patent eligibility issues under 35 U.S.C. § 101. He is the current Chair of The Sedona Conference® Working Group 9 (Patent Damages and Remedies), a member of the core drafting team of Working Group 10 (Patent Litigation Best Practices) and currently serves on the WG9 & 10 Steering Committee.
