Holly has more than 30 years of government contracts experience, including 10 years with a Fortune 50 systems integrator as subcontracts manager, where her experience included bid and proposal efforts as well as drafting, negotiating, and administering a broad range of federal government subcontracts. Holly focuses her practice on a wide range of counseling and litigation relating to federal, state, and local government procurement matters as well as federal assistance agreements and grants. Because of her superior client focus and forward thinking solutions, Holly was recognized as a 2018 Client Service All-Star by BTI Consulting. For the past five years, Holly has been ranked by Chambers as a leading Government Contracts practitioner.
Holly advises clients on compliance programs, protests, claims, disputes, Office of Inspector General audit and investigation responses, and proposed suspensions and debarments. She also advises clients on regulations that govern civilian and DoD agencies’ acquisition of technology, both commercial and developmental, and the application of the Bayh-Dole Act. She has extensive experience with commercial (including GSA and VA Federal Supply Schedule), developmental, Brooks Act (architect and engineering) and construction contracts with the federal government and prime contractors, and has advised clients on foreign military sales and direct commercial sales using foreign military financing. The range of her experience includes firm fixed-price, time and material and cost-plus type contracts.
Her experience includes the full range of government contract M&A issues, such as due diligence to evaluate and mitigate the risk associated with acquiring a government contractor, and review and assessment of the potential target's compliance programs. Holly advises clients on the scope of representations required in stock and asset purchase agreements, CFIUS filings and the applicability of novation agreements and information required to be included in novation agreements.
Holly has successfully represented clients in claims and disputes before state and federal Boards of Contract Appeals and the Court of Federal Claims and in suspension and debarment proceedings before agency Suspension and Debarment Officials. Holly has successfully brought, and defended against, bid protests at the Government Accountability Office, the Court of Federal Claims and the Federal Aviation Administration. Holly’s practice includes investigations and litigation brought under the False Claims Act.
She represents clients before the Small Business Administration Office of Hearing Appeals and counsels clients on compliance with the Small Business Administration’s Government Contracting Programs.
Holly advises clients on the post-employment and conflict of interest restrictions that apply to federal government employees as well as the standards of ethical conduct for federal government employees.
