At Last: A Law in the Works That Protects Lawyers Assisting Clients in the Cannabis Industry

Recently, the ABA voted to support legislation that would protect lawyers who represent marijuana enterprises operating legally within the state in which they do business. This law, if enacted, would shield lawyers from criminal prosecution as "aiders or abettors" and from regulatory enforcement. The lobbying effort is just beginning so stay tuned. 

Specifically, ABA Resolution 103B asks Congress to adopt legislation "to clarify and explicitly ensure that it does not constitute a violation of federal law for lawyers, acting in accord with state, territorial, and tribal ethical rules on lawyers’ professional conduct, to provide legal advice and services to clients regarding matters involving marijuana-related activities that are in compliance with state, territorial, and tribal law."
