A large, complex asbestos-driven bankruptcy. As debtor's counsel, negotiated large contributions from prior owners of these companies and from insurance companies to fund the asbestos trusts that enable an exit from bankruptcy.
Represent BNY Mellon Corporate Trustee Services Limited, as the Delegate under a Declaration of Trust between the BNY Mellon Corporate Trustee Services Limited, Arcsukuk (2011-1) Limited (in its capacity as Issuer and Trustee) and Arcapita Bank B.S.C, as a member of the Official Committee of Unsecured Creditors.
Represented Michigan and New Jersey municipalities in chapter 11 proceedings relating to the enforcement of real and personal property tax liens, sale of property, and defense of preference actions
Represented automotive suppliers in accommodation agreements and workouts
Represented Och-Ziff Capital Management Group, in cooperation with Kwiat Enterprises, LLC, in the $25 million acquisition of the assets of Fred Leighton Holdings, Inc. out of bankruptcy. Fred Leighton is an estate jewelry retailer with stores in Las Vegas and New York.
Represented an insurance company in asbestos related bankruptcy proceedings in the District of Delaware, obtaining valuable plan modifications in contested confirmation hearing
Represented the successful stalking horse bidder in the acquisition of $5 million in assets in the Bankruptcy Court for the District of Washington, including the negotiation, design and drafting of the sales procedure order and the asset purchase agreement
Represented two consumer goods manufacturing and distribution companies in acquiring significant assets through competitors’ Chapter 11 bankruptcies
Successfully represented our client, an international equipment manufacturer, in a dispute by bankruptcy creditors of a debtor in which a fraudulent conveyance was alleged in bankruptcy court in Delaware.  In a related case, Reed Smith obtained a dismissal of a case that was filed in the United States District Court for the Southern District of Texas in Houston.
Represented a publicly traded publishing company in bankruptcy litigation in the Northern District of California concerning the attempted subordination of $1 million in claims
