The Fourth Amendment & Privacy In The Digital Age: The Supreme Court's Cell Phone Cases & What's Next

At the end of the 2013-2014 Term, the Supreme Court decided a pair of groundbreaking cases applying constitutional protections against unreasonable searches and seizures to police searches of cell phones incident to arrest. This program will review those rulings and discuss their implications for criminal law and beyond. Is the Court developing a more robust Fourth Amendment doctrine for law enforcement searches in the digital age? What does this mean for cases related to national security and data collection? What do attorneys need to know to protect their clients? Please join experts on criminal and constitutional law, privacy, and the Supreme Court, as we explore these topics and more.

  • Elizabeth B. Wydra, moderator, Chief Counsel, Constitutional Accountability Center
  • Tillman J. Breckenridge, leader of appellate practice in D.C. and Virginia for Reed Smith LLP, and adjunct professor of law and managing attorney at William & Mary’s Appellate and Supreme Court Clinic
  • Orin S. Kerr, nationally recognized scholar and expert on electronic evidence, criminal law, and privacy, and professor at George Washington University Law School
  • Alan Butler, Appellate Advocacy Counsel for Electronic Privacy Information Center (EPIC), and frequent litigant in cases covering national security, privacy, electronic communications, and other digital Fourth Amendment issues.
