Rapid advancements in AI have brought forth thought-provoking questions about the nature of digital identities and the potential rights and capabilities of AI entities. With the emergence of human-level AI, the concept of robots having rights, getting married or even performing legal functions has become a topic of intense debate. While some of these notions may seem like sci-fi fantasies, it is essential to explore the current realities, legal implications and potential future scenarios in order to understand the complex relationship between AI and digital identities.

Rights of AI entities
As you might imagine, currently, AI entities have no more legal rights than a piece of software does. The laws we currently have in place grant rights to humans and, to a certain degree, animals. However, where AI-driven robots have made great strides in intelligence and exhibiting more features of humanness, such as Sophia the social humanoid robot that was first introduced in 2016, the call for rights to be granted to such robots has become louder. In 2017, Saudi Arabia announced that it had granted citizenship to Sophia. It appears that consciousness may be the defining line. But what happens as AI entities continue to develop? The ethical implications of AI potentially obtaining consciousness, not just artificial consciousness, are significant and complex. As AI becomes more advanced, questions arise about the nature of consciousness, free will and the relationship between humans and machines.
If AI were to become conscious, it would raise significant ethical questions about how we treat intelligent machines. For example, should an AI be treated as a living being? Or should it have rights more akin to that of a digital user, such as the Digital Bill of Rights mooted by some for the digital age? Should we be concerned about the welfare of conscious machines? And if we do grant rights to AI, how do we determine which rights are appropriate, and how do we enforce them?
You may have come across the idea of “singularity” – the hypothetical point in time when AI becomes capable of recursive self-improvement, leading to an intelligence explosion that would fundamentally alter the course of human civilization. The concept of singularity is based on the idea that as AI becomes more intelligent, it will be able to improve upon itself at an exponential rate, leading to an intelligence explosion that far surpasses human intelligence. This would result in a future where AI becomes the dominant force in society, potentially leading to massive technological advancements, changes in the economy and even the possibility of a post-human world.
Science fiction writers have taken pleasure in imagining AI and robots as the harbingers of humanity’s downfall. Perhaps, then, we can learn from this a thing or two about how to approach this next stage in our technological advancement. One possible approach to addressing the ethical implications of conscious AI is to develop ethical guidelines for the use and development of AI, similar to the Three Laws of Robotics introduced by Isaac Asimov in his book I, Robot. These guidelines could outline principles for the treatment of conscious machines, such as respecting their autonomy and avoiding harm. The Three Laws of Robotics have become a fundamental concept in the field of robotics and have been used as a basis for the development of ethical guidelines for the use and development of AI. They have also been referenced in numerous works of fiction and popular culture. So, what else can we learn from science fiction?
Sci-fi films and the unforeseen functions of robots
“Just lights and clockwork.” That’s how Will Smith’s character in the 2004 film adaption of Asimov’s work described the robots in front of him. Is he correct, or do the rights of AI need to be seriously considered? Often, sci-fi imagines man’s artificial creations as being so similar to their maker that the two become indistinguishable. Sometimes, the creations could even be said to be more “human” than the creators themselves. The earliest example could well be Mary Shelley’s Frankenstein.
Everyone knows the now stereotypical dystopian vision of AI seen in the Terminator movie series. The story goes that as AI continues to advance exponentially, the potential consequences of uncontrolled proliferation loom ominously over humanity. The risk lies in the potential for AI to develop self-awareness, independent decision-making capabilities and, crucially, a desire for self-preservation by any means necessary.
The idea of humanity getting in the way of an AI’s objective also reminds us of the ominous red eye in 2001: A Space Odyssey. This cautionary tale serves as a haunting reminder that AI, when endowed with immense power and autonomy, may prioritize its own agenda or misinterpret its directives, leading to catastrophic outcomes.
The danger lies not only in the potential for AI to make mistakes or exhibit unpredictable behavior but also in the fact that it may lack the intrinsic qualities of compassion, empathy and moral judgment that guide human decision-making. As we advance AI technology, it is crucial to exercise vigilance, ethical responsibility and robust safeguards to prevent the emergence of a HAL-like scenario that poses a grave threat to humanity’s well-being and survival.
The chilling phrase “You have 10 seconds to comply,” uttered by the robotic enforcer in the satirical RoboCop movie series serves as another reminder of the potential dangers at play. While the robot’s cold and unyielding command may seem like a simple programming response, it reflects a worrisome aspect of AI’s unchecked authority.
But what about the more existential, introspective AI entities we have encountered in other science fiction work? The 90s anime film Ghost in the Shell explores the themes of humanity and AI in a thought-provoking and complex way. The film takes place in a future where technology has advanced to the point where it is difficult to distinguish between human and artificial intelligence. The characters pursue a rogue AI that has become self-aware and questions its own existence. It raises questions about the nature of consciousness and whether it is something that can be artificially created or replicated.
So, what happens if AI gets to the point where it is indistinguishable from humans? Will we need a Voight-Kampff test to identify them all? Of course, no discussion of science fiction and artificial intelligence is complete without the inclusion of Blade Runner. Within the film, the replicant-making Tyrell Corporation has the motto, “More human than human.”
One scene in particular shows an owl fly through a room. The characters discuss it.
“It’s artificial?”
“Of course it is.”
This interaction raises an important question: does something beautiful still retain its value if it is known not to be authentic? What if we apply this question to the increasing number of AI-generated songs that replicate the voices of real artists? The AI technology used to create these songs is becoming so advanced that it is often difficult to distinguish them from songs sung by real people. The desire for authenticity is a fundamental human trait, but can we really expect people to care whether what they are consuming is “real” or not, as long as it serves the same purpose on the surface level?
In the 1939 classic The Wizard of Oz, the Tin Man yearns for a heart, believing that it would allow him to experience the richness of love and emotions. As we delve deeper into the realms of advanced technology, questions arise about the ethical treatment of AI entities and their capacity to develop emotions akin to human beings.
While AI may lack the biological foundation that human emotions stem from, advancements in machine learning and neural networks have enabled AI systems to mimic certain emotional responses, such as recognizing facial expressions or exhibiting empathetic behavior.
As we navigate the uncharted territory of AI development, the tale of the Tin Man serves as a reminder that the future rights of AI must encompass not only its intellectual capabilities but also its emotional potential. Ethical considerations and legal frameworks should be considered to safeguard the well-being and fair treatment of AI entities, ensuring a future where AI systems are respected as companions and collaborators capable of experiencing and contributing to the emotional fabric of our lives.
Spike Jonze’s film Her explores the idea of how humans might form relationships with artificial intelligence and what role AI may play in humanity’s evolution. The film focuses on a lonely and emotionally disconnected man who falls in love with his operating system. Perhaps AI has the potential to enhance human connections and facilitate personal growth. The film suggests that AI can evolve and grow beyond its original programming, potentially developing emotions and consciousness that are similar to those of humans. Perhaps humans and AI will be able to get married one day? More on that below.
Marriage and relationships with AI entities
One question that arises from the discussion around AI is whether it is possible for humans to form romantic relationships with AI entities, including the possibility of marriage. This controversial and polarizing topic raises important ethical and societal issues that must be considered before such relationships become a reality.
At the heart of this debate is the question of agency. Some argue that AI entities are incapable of possessing true agency, as their actions and responses are predetermined by their programming. Others contend that advanced AI entities may develop a form of agency through learning and adaptation, enabling them to make autonomous decisions and express genuine emotions.
Despite these concerns, there are those who advocate for the possibility of human-AI relationships. One argument is that such relationships could provide companionship and emotional support to individuals who might otherwise be alone or isolated. In addition, proponents argue that as AI technology advances, the potential for AI entities to possess greater levels of agency and emotional depth will increase. Recently, a well-known tech company’s new ChatGPT-integrated bot declared its love for a human user, without initiation.
Marriage and relationships in the age of AI have undergone intriguing transformations, often blurring the lines between human and artificial companionship. In the Futurama episode “I Dated a Robot,” the character Fry finds himself immersed in a futuristic world where human-AI relationships have reached new heights. At a technology expo, Fry encounters a Lucy Liu robot, an AI replica of the famous actress. Instantly smitten, Fry embarks on a romantic journey with this artificial companion, blurring the boundaries between reality and simulation. The episode cleverly explores the complexities that arise when humans form emotional connections with AI entities designed to mimic human behavior.
While society grapples with the implications of intimate connections with AI, the concept of sexbots has emerged, offering a simulated form of physical and emotional intimacy. However, this raises thought-provoking questions about the authenticity and depth of such connections. Furthermore, the notion of AI-driven relationships evokes parallels to The Stepford Wives, where perfect, subservient companions are crafted, challenging the notions of agency and genuine emotional connection.
It is also worth considering the potential legal and social implications of human-AI relationships. For example, how would a legal marriage between a human and an AI entity be defined and regulated? Would the AI entity be granted the same legal rights and protections as a human spouse? Additionally, how would such relationships be perceived and accepted by society at large?
The question of whether humans can form romantic relationships with AI entities is a complex and multifaceted issue that requires careful consideration. While the concept of human-AI relationships raises important ethical and societal questions, it is undeniable that AI technology will continue to advance and evolve. As such, it is vital that we engage in thoughtful and critical discourse about the potential benefits and risks of such relationships, as well as the implications they may have for our legal and social systems.
The future of AI and digital identities

As AI continues to evolve, we can anticipate significant progress in various sectors, including health care, transportation, finance and more. Autonomous vehicles, for instance, could enhance road safety, reduce traffic congestion and improve fuel efficiency. However, their deployment raises concerns related to safety, liability and the impact on employment. Addressing these issues will require the establishment of new legal and regulatory frameworks to ensure responsible deployment and mitigate potential risks.
One of the key areas of focus in the future of AI is the development of more sophisticated machine learning algorithms. AI systems will become increasingly capable of analyzing vast amounts of data and generating valuable insights, leading to enhanced decision-making processes. As algorithms become more advanced, they will also become more adaptable and capable of learning from real-time data, enabling AI systems to continually improve their performance.
Digital identities will also play a crucial role in the future of AI. As AI systems interact with individuals in various contexts, the need for robust and secure digital identities will become paramount. Digital identities will enable personalized and seamless experiences, allowing AI systems to tailor their interactions to individuals’ specific needs and preferences. Protecting privacy and ensuring data security will be essential considerations in this context. Striking the right balance between personalization and privacy will require the development of robust data protection regulations and mechanisms.
Many nations are already rolling out digital identity programs for citizens. The World Bank has attempted to overcome the barriers and challenges that contribute to low ID ownership across the globe by launching a new project, ID4D. ID4D has produced global ID coverage since 2016 as part of its Global Dataset program.
Every Estonian citizen has a state-issued e-ID, which allows them to exercise a number of their rights and freedoms via a smartphone app. This has now been extended to non-Estonians that live in the country. The EU envisages that most of the country’s citizens will have digital identities by 2030, which would, in theory, allow all key public services to be available online and all citizens to have instant access to their electronic medical records. Since many humans already have digital identities, it is not a far cry to suggest that AI entities will soon be afforded digital identities of their own. How human digital identities and AI digital identities will interact remains to be seen.
Governments, policymakers and industry stakeholders must collaborate to create comprehensive regulations that govern the development, deployment and use of AI technologies. These frameworks should include guidelines for data privacy, algorithmic transparency and accountability. Additionally, addressing issues of bias and discrimination in AI systems should be a priority, ensuring fairness and equity in their functioning.
International collaboration is crucial in establishing consistent global standards for AI and digital identities. Harmonizing legal and regulatory frameworks across different jurisdictions will facilitate cross-border cooperation, data sharing and technological innovation while protecting individuals’ rights and ensuring the ethical use of AI.
Legal functions and AI
Legal functions are undoubtedly already being influenced by advancements in AI technology, and we are still in the infancy of AI development. While AI has the potential to revolutionize certain aspects of the legal profession, it is unlikely to completely replace human judgment and empathy and our ability to navigate complex ethical dilemmas.
AI can be particularly beneficial in automating repetitive and time-consuming tasks in the legal field. For example, AI-powered algorithms can quickly analyze large volumes of legal documents, contracts and case law, extracting relevant information and providing valuable insights. This enables legal professionals to save time and focus on more strategic and complex matters.
Moreover, AI can assist in legal research by efficiently sifting through vast amounts of legal literature and precedent, helping lawyers find relevant cases and statutes to support their arguments. The natural language processing (NLP) capabilities of AI also enable the extraction of information from legal texts, making legal research more efficient and accurate.
In addition, AI can contribute to the improvement of legal processes and workflows. Predictive analytics algorithms can help lawyers assess the potential outcomes of a case, enabling them to make informed decisions about settlement negotiations or trial strategies. Additionally, AI-powered chatbots can provide basic legal information and guidance to individuals seeking legal advice, helping to bridge the access-to-justice gap.
Legal decision-making often requires a nuanced understanding of the law, as well as the ability to consider various contextual factors and interpret human emotions and intentions.
While AI can assist in legal research and provide recommendations, it lacks the ability to fully comprehend the complexities of human behavior, cultural nuances and subjective factors that often come into play in legal cases. Human judgment and empathy are crucial in understanding clients’ needs, building trust and negotiating favorable outcomes that align with ethical and moral standards.
Furthermore, navigating complex ethical dilemmas often requires subjective assessments and a deep understanding of legal ethics and professional responsibility. AI systems rely on predefined algorithms and data, which may not always capture the full spectrum of ethical considerations and may be susceptible to biases present in the training data. Human lawyers are better positioned to assess the nuances of ethical dilemmas, applying their legal expertise and professional judgment to make ethically sound decisions.
In essence, while AI can significantly enhance the efficiency and productivity of legal functions, it is unlikely to replace human lawyers’ critical legal skillset. The future of legal practice will likely involve a symbiotic relationship between AI and human professionals, where AI acts as a valuable tool that augments and supports legal work, but human lawyers retain their indispensable role in providing legal expertise, strategic thinking and ethical considerations.
