Nicholas regularly advises credit facility agents, institutional and individual lenders, formal and informal committees, and other credit providers facing insolvency-related issues both in- and out-of-court, with a particular focus on complex chapter 11 restructurings and intercreditor arrangements. In addition, Nicholas has company side experience representing purchasers of distressed assets and debtors in chapter 11 as well as out-of-court workouts.

Represented an ad hoc group of revolving lenders: advising in connection with the multi-jurisdictional prearranged Chapter 11 cases filed by Nordic Aviation Capital, and with over $7.7 billion of liabilities, the largest chapter 11 filing in 2021.
Represented third-party administrative agent and collateral agent under $1.2 billion TLB facility in connection with the enforcement of secured lenders’ rights including exercising control over domestic and foreign assets, including taking control of U.S. and foreign subsidiaries and accounts, and enforcing such actions through various State, Federal and foreign court proceedings.
Represented Citibank, N.A.: advising the administrative and collateral agent for a $285m reserve-based lending facility in the Lonestar Resources U.S. Inc. chapter 11 cases.

Represented a senior secured noteholder in $2 billion chapter 11 restructuring of CLO entities including monetization of collateral and underlying portfolio assets.
Represented French company Sercel Holding SAS and its U.S. affiliate, Sercel Inc., in connection with the purchase of debtor and non-debtor technology assets and business segments in connection with the Chapter 11 cases filed by Ion Geophysical Corporation.
Represented receivers appointed by Singaporean based fund as mezzanine lender secured by properties and development projects located in Australia and the U.S. in connection with the corporate restructuring of the debtors’ U.S. entities and consensual workout of the existing defaulted senior term loan facility.
Represented group of Asian based hedge funds as senior secured lenders under multiple credit facilities in an out-of-court, cross-border restructuring of an international manufacturing group, including Dutch, Cayman, Indian and U.S. entities, including the implementation of a new U.S. Holdco structure to accommodate additional equity capital contributions as well as the consensual workout of existing debt facilities governed by English and U.S. law.
