FTC Issues Staff Perspective on Video Game Loot Boxes

What is notable about the FTC’s Issue Perspective Paper on Video Game Loot Boxes, which is a follow up from the 2019 workshop held by the FTC on loot boxes, is that each of the staff's call outs is very much in line with current FTC practice: (1) If you call out the odds in connection with a loot box, you better be sure they’re accurate and nonmisleading; (2) Do the best you can to make the costs associated with loot boxes clear and transparent; and (3) In the context of influencers in the gaming area, make sure you disclose any material connection.

The paper highlights public concerns raised about loot boxes, emerging academic research, and industry self-regulatory initiatives discussed at the workshop and in comments submitted to the public docket.
