Vaccines – and allowable remedies for alleged vaccine injuries – are currently the subject of national discussion and considerable misinformation. This session begins with an overview of the basics of vaccine product liability, explaining the 1986 Vaccine Act, civil claims the Vaccine Act allows and prohibits, and the impact of the National Vaccine Injury Compensation Program on product liability. The session then takes a deep dive into both vaccine-related federal multidistrict litigation and examines the defenses vaccine manufacturers have asserted in such litigation. The session concludes with a discussion of the PREP Act and how that statute largely precluded product liability litigation against manufacturers of vaccines and other COVID-19-related treatments during and after the recent pandemic.
