The practical implications of the COVID-19 pandemic on the construction industry have been far-reaching, and have significantly impacted projects worldwide. During our first workshop, we examined these practical implications through the lens of on-going projects. However, the continuing effects of the pandemic, and both the domestic and international measures taken to respond to it, are not just limited to on-going projects, but are also complicating the negotiation of future projects.
Notwithstanding the current challenges the pandemic presents, some parties will be looking to enter into new projects. However, as no one can truly predict what the health situation will look like over the coming months, negotiating parties are faced with significant uncertainty and unpredictability. In such circumstances, it can be difficult to know where to start, and how to address the issues raised by the pandemic.

In this second and final interactive workshop that will revolve around a practical case study, we look to the future. Our dual panel of experts based in both Paris and Dubai, will explore and debate these complex and fast-moving practical considerations, from the viewpoint of their respective civil law jurisdictions.
This workshop will focus primarily on how to draft for the impact of COVID-19 or similar circumstances in future projects, and will look at a number of areas where impacts are likely to be seen and felt, including:
- The impact of the COVID-19 crisis on construction pricing;
- Apportioning COVID-19 associated risk;
- Drafting pricing and termination provisions; and more.
