When a Government Accountability Office bid protest is timely filed, the Competition in Contracting Act, 31 U.S.C. § 3553, imposes an automatic stay on all performance of the protested contract. An agency can, under certain limited circumstances, override the CICA stay but can do so only upon a written finding that performance of the contract is “in the best interests of the United States” or that other “urgent and compelling circumstances” will not permit waiting for resolution of the underlying bid protest.”
