Brian Himmel and Natalie Metropulos wrote “Insuring Against FCA Suits in the Health-care Industry,” which appeared in Corporate Counsel on November 5th. The article discusses the significant rise in the number of qui tam actions brought under the False Claims Act (FCA) over the past several years and the steps that providers should take to assess their current insurance coverage for defending and resolving these actions. Brian and Natalie highlight some of the key types of insurance that providers can obtain for FCA coverage – such as errors and omissions (E&O), employment practices liability (EPL) and directors and officers (D&O) – and how they can be used to the providers’ fullest benefit.
