The most significant change to patent law in the past 50 years is coming to Europe. On October 7, 2022, it was announced that the long-awaited Unified Patent Court (UPC) and the European Patent with Unitary Effect (Unitary Patent or UP) should become official on April 1, 2023 with the sunrise period beginning on January 1, 2023. This new system will significantly change the European patent landscape, and it should be at the top of your IP strategy. Reed Smith Paris partners Marianne Schaffner and Thierry Lautier present a series of podcasts about the coming changes and how to prepare your company. In this third and last episode of the podcast series, they address what to do if your company’s competitors have European patents, and provide valuable advice to help mitigate risks of injunction and damages in the “UPC zone”.
