Tate advises employers on matters relating to compliance with federal, state, and local employment laws and is an authority on labor and employment issues in the context of corporate transactions. He also maintains a robust employment litigation practice.
Tate is prepared to meet the day-to-day concerns of employers. He represents employers with respect to a diverse array of employment issues, including hiring and separation concerns, restrictive covenants, internal investigations, governmental investigations, policy and procedure reviews, and compliance with employment laws.
When disputes arise, Tate defends employers in matters involving claims of discrimination, retaliation, wrongful discharge, and whistleblower allegations under federal and state employment laws. Tate also has experience representing employers in wage and hour actions under the Fair Labor Standards Act (FLSA) and breach of contract actions. Additionally, he represents entities, as well as individuals, in restrictive covenant and trade secret disputes, including both enforcement and challenges to restrictive covenant agreements and claims of trade secret protection.
Tate also provides legal counsel regarding labor and employment issues related to business openings and closings, mergers and acquisitions (buy- and sell-side), and other business and corporate transactions. He has experience negotiating and drafting employment contracts, including employment agreements, restrictive covenant agreements, and separation agreements.
