Acted for an investment client in a £1.2 million claim against one of its tenants for the recovery of service charge arrears in respect of a number of floors in an office tower. The tenant counterclaimed in respect of the invoicing process, the charging of VAT (the landlord is offshore) and maintenance of services. The counterclaim was struck out and judgment obtained for the client. Following trial we were able to provide ongoing insolvency advice to our client with respect to its claim in the tenant’s administration. The tenant also brought a claim in the United States for the recovery of VAT. Lawyers in our Philadelphia and Wilmington offices succeeded in dismissing the claim.
Acted for a client on a rent review in respect of an oil terminal in the North East of England, which has been in dispute since 2014. The lease dated back to 1974 and was complex, relating to developed and non-developed land, and sea and river access. Having obtained a determination on the legal issues, the case was settled by an expert valuer.
Acted for an offshore property investor and two other offshore companies against an individual claiming £100 million in respect of the transfer of four properties in Mayfair, London. The claims included allegations of fraud and conspiracy in the context of the sale of the properties to our clients. Following several appeals by the claimant, the High Court case against our clients was dismissed. The claimant is subject to an extended civil restraint order. We also pursued a case to the Lands Tribunal, in respect of notices repeatedly registered by the claimant against the properties. An order refusing any further registration was obtained.
