Navigating Best Practices for GenAI Use: Recent Court Orders and Legal Implications

Courts are scrutinizing the use of GenAI tools in litigation, seeking to ensure that any attorney’s use of GenAI is in-line with their ethical obligations and the interests of their clients, and whether client or business use of GenAI may impact legal obligations.

In particular, recent case law and court orders have focused on two areas: (a) disclosure of the use of GenAI tools as a means to enforce appropriate use and (b) the risk of the waiver of attorney-client privilege and work product protections in the use of GenAI. This webinar will provide a discussion of the key cases and court orders impacting how GenAI is used in litigation, the practical implications of those rulings and what attorneys can do to avoid running afoul of their ethical obligations and to protect their clients.

CLE Information: This program is presumptively approved for 1.0 CLE credit in California, Connecticut, Illinois, New Jersey, New York, Pennsylvania, Texas, and West Virginia. Applications for CLE credit will be filed in Colorado, Delaware, Florida, Georgia, Ohio, and Virginia. Attendees who are licensed in other jurisdictions will receive a uniform certificate of attendance, but Reed Smith only provides credit for the states listed.
