Agathe Malphettes is a partner in the Entertainment & Media group in our Paris office.
With more than fifteen years of experience in the technology sector, Agathe advises international groups – particularly in the financial services, transportation, and luxury industries – as well as leading digital players on their most complex litigation, regulatory, and contractual matters, both in France and internationally. Her practice spans intellectual property and unfair competition, IT and internet law, data protection and privacy, consumer law, digital content regulation, cybersecurity, and artificial intelligence in a cross-border context.
Agathe regularly represents clients in high-stakes, cross-border disputes involving emerging technologies before civil and commercial courts and regulatory authorities, including the CNIL and DGCCRF. She also advises on the contractual structuring of IT projects, including SaaS, cloud computing, outsourcing, hosting, and maintenance agreements.
Agathe advises clients on regulatory developments affecting their businesses, including the French laws addressing online information manipulation, the law reinforcing respect for the principles of the Republic, the SREN law, the Digital Services Act (DSA), the NIS2 Directive, the Data Act, the AI Act, the GDPR, and other EU legislation (including Omnibus, Digital Content, Sale of Goods, and Copyright and related directives), as well as their implementation under French law. She also assists clients in leveraging and protecting their intellectual property assets via trademarks, designs, and copyrights – particularly in the context of strategic transactions.
Agathe spent nearly two years on secondment at Meta as Regulatory Litigation Counsel. She is a member of Cyberlex and the International Association of Privacy Professionals (IAPP).
Prior to joining Reed Smith, Agathe practiced for twelve years at White & Case. She began her career at Chanel in New York, before working at Alain Bensoussan and PDGB.
