Advises covered entities and business associates on HIPAA compliance issues, including negotiation of business associate agreements, preparation of HIPAA policies, and breach notification under HIPAA regulations and state law.
Counsels clients regarding consumer and patient communications and marketing, including consent requirements for text messaging under the TCPA and state law, requirements for promotional emails under CAN-SPAM, and guidelines for health-related advertising from the Digital Advertising Alliance and the Network Advertising Initiative.
