Michael is a partner in Reed Smith’s Labor and Employment Group. His practice focuses on the following areas:
Litigation. Michael has extensive experience defending employers against wage and hour class actions, collective actions, and Private Attorney General Act suits, as well as claims of discrimination, retaliation, and harassment. He has successfully represented clients in all phases of litigation, including investigation, discovery, law and motion, mediation, trial, and appeal.
Entertainment industry clients. Michael has a specific focus on advising and helping entertainment industry clients with employee issues, disputes, and risk mitigation. He is attuned to the various unique concerns in the entertainment industry, including those related to confidentiality and flexibility in employee schedules. Michael not only advises music labels and talent management companies, but also artists and high-net-worth individuals on the day-to-day employment issues that may occur. This includes specific employment issues related to touring personnel, household staff, and other support staff.
Mergers and acquisitions. Michael has extensive experience in managing employment issues that arise in mergers and acquisitions. He has handled employment issues for hundreds of large nine- and 10-figure deals. His experience includes advising on potential employment risks and presenting solutions, managing employee transfers and reductions, as well as advising on indemnification language and related deal terms.
C-suite contract negotiations. Michael has successfully negotiated countless executive employment agreements and compensation deals. He has a practical approach to these negotiations, based on his wealth of experience in both negotiations and litigating related contract disputes when necessary.
Reductions in force and employer reorganizations. Michael regularly advises on issues related to reductions in force, WARN triggering events, employee transfers, and employee reorganizations. He has specific experience with the California peculiarities and risk factors associated with these actions.
Start-up and technology companies. Michael regularly advises and helps prepare documents for companies that are looking to expand and grow their footprint, especially in the technology space. These clients often face unique issues related to contractor classification, multi-jurisdictional issues due to remote or traveling employees, as well as issues related to proper risk mitigation measures that arise when quickly expanding a company.
