Records & E-Discovery

Reed Smith’s Records & E-Discovery (RED) Group brings decades of experience to clients seeking innovative solutions to their discovery needs as well as counseling on effective information governance practices.

Electronic discovery and records management are significant concerns for clients. The costs, burdens, and risks surrounding e-discovery, if not properly controlled, can overshadow the substantive issues involved in litigation.

We collaborate with our clients and their counsel to develop tailored, cost-efficient, reasonable, and defensible plans to respond to the discovery needs of each matter, regardless of the size and scope of the litigation, and can assist in every phase of discovery. Our accomplished group of over 60 attorneys employs a technology-first strategy, leveraging technology tools to streamline the data subject to human review and fast-track data analysis. Even in cases where the firm is not primary merits counsel, we can serve as special discovery counsel or national discovery counsel to help clients achieve quality, cost savings, and consistency in their discovery practices.

Our team also serves as information governance counsel for many organizations. We work with clients to develop and implement information management policies and procedures to meet business, compliance, and litigation readiness needs. We assist with development of record retention schedules and related policies; backup and archiving strategies; litigation readiness; and defensible remediation of obsolete information, including both electronic and hard copy document repositories. Going beyond advice on the legal implications of information governance programs, we have hands-on knowledge and work with legal, compliance/privacy, and IT teams to devise real-world solutions for our clients – transformational programs to modernize and bring information governance practices in line with current regulatory expectations and technology. We also advise clients on the defensible deployment of AI across all aspects of their businesses.

The group is known for its thought leadership and market-leading innovation, and provides guidance on a wide variety of issues, ranging from AI-enabled discovery to cross-border discovery to preservation, legal holds, collection, early case assessment, defensible culling practices, document review, production, and post-discovery needs. The leadership group developed and maintains the E-Discovery App, a popular public e-discovery resource, and produces Tech Law Talks podcasts and bi-monthly webinars on topics of interest to litigators and e-discovery practitioners.

“Reed Smith is well versed in discovery management issues arising during its clients’ most significant litigation. The group possesses notable capabilities in legal hold administration and in conducting custodian interviews.”
