False Claims Act cases continue to carry immense financial and reputational risks for employers. In fiscal year 2015, the U.S. Department of Justice netted $3.6 billion from FCA enforcement – the fourth year in a row that the DOJ exceeded $3.5 billion in recoveries under the Act. Most of the amount recovered arose out of cases involving whistleblowers ($2.8 billion in FY 2015). Recoveries related to alleged health care fraud topped the list in FY 2015, at $1.9 billion.
