Emese Simon, M.D. et al. v. Encompass Health Corp. et al.E, No. 8:12-cv-236 (M.D. Fla. Feb. 12, 2021); aff’d, No. 21-11618 (11th Cir. Aug. 31, 2022) – Obtained summary judgment on behalf of Encompass Health and its subsidiary in a False Claims Act retaliation action brought by a physician challenging medical diagnoses made by other physicians as “fraudulent”; affirmed by the Eleventh Circuit.
