He represents and advises debtors, secured and unsecured individual creditors and ad hoc creditor groups, special committees, and other stakeholders in all aspects of complex business, debt, and corporate reorganizations and restructurings, both in and out of bankruptcy court, including workouts, refinancing transactions, and asset sales and purchases. Derek negotiates and drafts chapter 11 plans, disclosure statements, term sheets, plan and restructuring support agreements, settlements, asset purchase agreements, and other related motion practice. He prepares for contested hearings and researches and analyses legal issues with respect to complex bankruptcy litigation and other insolvency related issues. He directly manages and interacts with clients and other professionals including financial advisors, investment bankers, and co-counsel.
