In the aftermath of major credit and financial crises coupled with increased government scrutiny and regulation of corporate governance and reporting, directors and officers are acutely aware of the potential for alleged and actual liability and the importance that directors’ and officers’ liability insurance afford sufficient coverage to provide for a defense and indemnity for any claim, settlement or judgment. This topic will provide you with insight into common issues and trends that arise during a claim for D&O liability insurance coverage. It will open with a discussion of the landscape of directors’ and officers’ liability, including the common allegations and recent claims trends brought in the wake of the credit and financial crises.
