Now that China’s Cybersecurity Law (CSL) is in full force, global companies with business interests in the region should be considering what they should be doing to ensure compliance with the CSL. Together with a dozen other related legislations, guidelines, and industrial standards already released or being drafted, the CSL presents an unprecedented challenge for international businesses with operations in China.

The path to CSL compliance is not straight-forward. The Chinese legislative and enforcement style creates confusion and misunderstanding, and sometimes false hopes, for Western companies. Despite this environment of uncertainty and change, the Chinese authority has already begun initiating enforcement actions for CSL violations. The same is expected when the data localization provision of the CSL goes into effect December 31, 2018. Companies operating in China need to take swift actions now to assess their specific obligations under the CSL, and take measures to mitigate the compliance risks.
