Title II of the Americans with Disabilities Act (“ADA”) was amended in 2011 to include regulations on the use of service animals in public institutions, programs, and facilities. 28 C.F.R. § 35.136.

While the regulations outline institutions’ obligations regarding the admission of service animals in public schools, there are still unresolved issues being addressed by agency and judicial decisions. In addition to the ADA, this program will also touch on institutions’ obligations under Section 504 of the Rehabilitation Act of 1973 and the Fair Housing Act.
