Declaratory Judgment actions are also a common feature in coverage disputes. This ACCC Pop Up Dialogue will discuss some recent developments in removal/remand law, and strategic considerations from both the policyholder and insurer perspective, as well as a pending case before the 9th Circuit addressing whether a counterclaim for bad faith in a declaratory judgment action is compulsory (thus requiring mandatory jurisdiction) or contingent (allowing the federal court to exercise its discretionary authority to abstain).
