From digital artwork to play-to-earn games, to collectibles, they are being used as a new form of “digital property” by creators, content owners and by brands to engage with their customers in innovative ways. But as the sophistication of NFT offerings develops and regulators start to direct their attention to crypto and digital assets, it becomes increasingly important to consider whether what is being offered inadvertently triggers financial regulatory scrutiny. We take a look at some of the models we are seeing emerge from the media and entertainment world and discuss with our UK, US and Singapore regulatory experts what one should watch out for when minting a new NFT.
