Members of the Reed Smith Life Sciences Health Industry Group serve as outside counsel to AdvaMed, the world’s largest trade organization representing medical technology manufacturers.
The revised AdvaMed code is effective June 1, 2022, and was updated to address arrangements to advance value-based care, consistent with new Anti-Kickback Statute value-based safe harbors, and the U.S. Department of Health & Human Services, Office of Inspector General’s November 2020 Special Fraud Alert on speaker programs.
AdvaMed also issued revised FAQs and a standalone guidance document. Key updates include guidance on various issues, including:
- Providing alcohol at company-conducted programs and meetings;
- Virtual meetings and programs;
- Interactions and arrangements with health care professionals relating to value-based care (for example, results-based, outcomes-based, or performance-based arrangements); and
- Leveraging data and technology to provide innovative solutions and cost-effective care.
