Jenn Eppensteiner and Julia Fradkin wrote “Advising Clients on MDL Consolidation,” which appeared in the January 21st edition of the Defense Research Institute’s (DRI) online newsletter, The Voice. In the article, Jenn and Julia provide advice on the considerations that attorneys should take into account when deciding whether a multidistrict litigation (MDL) is appropriate for their client’s particular product liability litigation. Attorneys should become familiar with the provisions used by the Judicial Panel on Multidistrict Litigation to determine whether a series of cases should be consolidated into an MDL. By doing so, attorneys can provide the panel with valuable input on the appropriateness of consolidation and – if deemed appropriate – the forum in which such an MDL should be located.
