The revised ICDR Rules incorporate the essence of the ICDR Guidelines for Arbitrators Concerning Exchanges of Information created in 2008.

The tribunal is mandated to manage the exchange of information among the parties with a view to maintaining efficiency and economy. The Rules provide direction and clarity for the arbitrator(s) and parties in relation to the exchange of documents—including electronic—and privileged communications. Article 21 also provides that depositions, interrogatories, and requests to admit generally are not appropriate procedures for obtaining information in arbitrations under these Rules. This session will focus on pre-hearing issues. Participants represent the institution, an arbitrator tribunal, counsel, and the clients.
